TPS Update – Supreme Court Rules Government Can Terminate TPS Status for Haitians and Syrians

On Thursday, June 25, 2026, the Supreme Court ruled that federal courts cannot review any determination of the Secretary of Homeland Security with respect to the designation, or termination or extension of a Temporary Protected Status (TPS) designation. Accordingly, the government’s termination of TPS for Haitians and Syrians was approved.

The Supreme Court, however, ruled that federal courts can review constitutional challenges, but the Supreme Court doubted that the Haitian plaintiffs could prove their equal protection challenge based on race discrimination. As a result, the Supreme Court terminated the interim relief that prohibited termination of TPS status.

The Department of Homeland Security will issue further guidance in the next few days. Meanwhile, employers with Haitian or Syrian employees who have TPS status should make plans for their loss of employment authorization.  In the next few days we should learn when termination of employment has to occur.
